Specialty Occupation for Australians (E-3)

E-3 is a visa category only for Australians going to the United States to work temporarily in a specialty occupation. To qualify for an E-3 visa, an applicant must demonstrate:

(a) that he or she have a legitimate offer of employment in the United States
(b) that the position he or she is going to fill qualifies as specialty occupation employment
(c) that he or she is an Australian citizen
(d) that he or she has the necessary academic or other qualifying credentials
(e) that his or her stay will be temporary, and
(f) if required before the alien may commence employment in the specialty occupation, that he or she has the necessary license or other official permission to practice in the specialty occupation.

The E-3 visa requires that a Labor Condition Application (Employment and Training Administration Form, ETA 9035), with attestations by the sponsoring employer related to wages and working conditions, be filed with, and approved by the Department of Labor (DOL). The employer in the United States may wish to contact the local DOL directly about this matter. Their website is http://dol.gov.
